Terms of use

1. Purpose and acceptance

These terms govern access to and use of qontexta.ai, the AI context platform that connects to your data warehouse and generates an AI-ready semantic layer — MCP server, REST and GraphQL APIs and Semantic SQL (the «Service») — owned by Mind Analytics SL, with tax ID B86740743 and registered office at Ronda de Sant Pere 16, 08010 Barcelona, Spain («Mind»).

By creating an account or using the Service you accept these terms and the Privacy policy. If you act on behalf of an organisation, you represent that you have authority to bind it, and «you» will also refer to that organisation.

2. The account

To use the Service you need an account with accurate and up-to-date information. You are responsible for keeping your credentials confidential and for all activity carried out from your account, including calls made with API keys or MCP tokens issued to you. Notify us without undue delay of any unauthorised use. You must be of legal age to register.

3. Plans, pricing and billing

The Service is offered under different plans, including a free plan. Current prices and features are published at qontexta.ai. Paid subscriptions are billed in advance on a recurring basis (monthly or annually) and renew automatically unless cancelled beforehand. Amounts paid are non-refundable, unless the law provides otherwise.

Each plan includes limits on usage — among others, the number of connected warehouses, modelled metrics, seats and queries or tool calls per period. Mind may apply fair-use controls and rate limits to protect the Service, and may offer to upgrade your plan when you exceed the limits of your current one.

Mind may change prices with reasonable prior notice; the new price will apply from the following billing period. Applicable taxes are not included unless expressly stated.

4. Acceptable use

You undertake not to use the Service for:

(a) unlawful activities or activities that infringe third-party rights; (b) uploading malicious content or content that infringes intellectual property rights; (c) attempting to access systems, accounts or data of other customers without authorisation; (d) reselling, sublicensing or making the Service available to third parties beyond what your plan allows; (e) deliberately overloading or interfering with the Service infrastructure, including the fair-use limits of the API, the MCP server and the Semantic SQL endpoint; (f) connecting warehouse credentials with broader permissions than necessary, or credentials you are not authorised to use.

5. Warehouse connection and your data

The Service connects to your data warehouse (BigQuery, Snowflake, Databricks, Redshift, PostgreSQL and other supported sources) through a connection you configure. You are responsible for providing read-only credentials, scoped to the datasets you wish to model, and for revoking them when you stop using the Service. Your data stays in your warehouse: Mind does not replicate it, and queries are executed against your source at the time they are requested.

The data you model and query through the Service («Customer Data») — including your schema metadata, domain and metric definitions, and the results returned by your queries — is and remains yours. You grant us only the licence necessary to host, process and display it in order to provide you with the Service. With regard to the personal data contained in Customer Data, Mind acts as a processor under the GDPR.

You are responsible for the lawfulness, quality and integrity of Customer Data and for holding the rights required to process it in the Service. On termination you may export your semantic model for a reasonable period, after which it will be deleted.

6. AI-assisted features and outputs

The Service uses AI models to draft domains, metrics and descriptions from your schema, and to answer questions over your semantic model. To do so, schema metadata, your model definitions and the content of your requests may be sent to the model providers acting as our sub-processors. Mind does not use Customer Data to train foundation models, and requires its AI sub-processors not to do so either.

AI-generated outputs — drafted models, generated SQL, and answers — may be inaccurate or incomplete. They are a starting point that you must review before approving a model or relying on a figure for a business decision. Mind does not warrant the accuracy of AI-generated content and is not liable for decisions taken on the basis of it without review.

7. Third-party agents and clients

The Service is designed to be consumed by AI agents and third-party tools (Claude, ChatGPT, Gemini, BI tools and your own applications). When you connect one of them, you decide what context and results leave the Service towards that provider, and that provider's own terms and privacy policy govern what it does with them. Mind has no control over, and assumes no responsibility for, those third-party services.

8. Intellectual property

The Service, its software, design, trade marks and documentation are the property of Mind or its licensors. We grant you a limited, non-exclusive and non-transferable licence to use the Service in accordance with these terms and your plan. No other right is transferred to you.

9. Availability and changes to the Service

We work to keep the Service continuously available, but we do not warrant uninterrupted or error-free availability. We may carry out maintenance, updates and improvements, and modify or withdraw features, seeking to minimise the impact and giving reasonable notice when the change is substantial. Availability also depends on your warehouse being reachable, which is outside our control.

10. Backups and continuity

Mind performs automatic daily backups of the platform data — your account, semantic models and configuration — with a minimum retention of 30 days and point-in-time recovery in the production environment. Backups are stored in a geographic location different from that of production data and are verified periodically to ensure their integrity and recoverability. Your warehouse data is not replicated by Mind and therefore remains covered by your own backup policy.

Mind also maintains a disaster recovery plan (DRP) with regularly tested procedures. You can consult the details in the security documentation (docs.qontexta.ai) and request the RTO and RPO values applicable to your plan by writing to support@wearemind.io.

These backups are intended for the continuity of the Service and do not replace the exports you may wish to keep by your own means, which you can perform at any time with your plan's export feature.

11. Limitation of liability

To the maximum extent permitted by law, Mind will not be liable for indirect damages, loss of profit, loss of business or loss of data arising from the use of or inability to use the Service. Mind's total liability for any claim relating to the Service will be limited to the amount paid by you in the twelve months preceding the event giving rise to the claim.

Nothing above limits liabilities that cannot be excluded under applicable law, including liability arising from wilful misconduct or gross negligence.

12. Suspension and termination

You may cancel your account at any time from the platform itself. Mind may suspend or terminate access to the Service in the event of a material breach of these terms, non-payment, or use that puts the security or integrity of the Service at risk, giving prior notice where reasonably possible.

13. Changes to the terms

We may update these terms to reflect legal or Service changes. We will publish the current version on this page with its update date and, if the change is substantial, we will notify you with reasonable notice. Continued use of the Service after the changes take effect implies your acceptance of them.

14. Governing law and jurisdiction

These terms are governed by Spanish law. Any dispute will be submitted to the courts and tribunals of Barcelona, unless consumer regulations or another mandatory rule provide for a different venue.
